At Horseyard, it is important to us that all of our users have a safe, successful and enjoyable experience. Whether you are hoping to buy or to sell a horse, following these tips and guidelines will help you safely navigate our site. Staying Safe while Using Horseyard

  • When buying or selling a horse online, an in-person meeting should always be arranged in order to examine the horse and to exchange money. It is advisable to also take someone with you when meeting with a seller at their location, your home or workplace. Another safety precaution you can take when answering an ad is to request the poster to produce identity and proof of qualification before meeting with them.

  • Always arrange for a veterinarian to examine a horse before agreeing to a sale. Make sure that the horse in question is the same horse listed in the ad. Inquire after any previous health and soundness issues the horse might have had in the past or is presently dealing with.

  • Be very cautious in how you exchange money for a sale. Never send or wire money to someone you do not know; this includes mailing cheques and using certain payment services. Bidpay, Western Union or Money Gram, for example, have been known to be forms of fund transfer that are favoured by fraudsters.

  • Horseyard does not offer any kind of buyer protection / payment programs. If you receive an email guiding you to refer to buyer protection/payment systems, please disregard the promotion of such services and report it to us.

  • Horseyard does not offer any kind of live chat support. Please be sure to disregard any emails you might receive that contain a live chat link. If you do receive such an email, please be sure to report it to us.

Scams to Look Out for

Fraudulent Sellers - Be aware that scammers may try to contact you via text messages or phone calls. They may give you a list of reasons as to why they are unable to meet in person, but continue to ask you about receiving payment. Keep in mind that scammers will pose as genuine sellers, post fake ads and/or approach you through email or on a social media platform. Be aware that scammers may also claim to be overseas traveling or have a sudden emergency come up and request that payment occur prior to arranging the delivery. They may also request that you give the payment to a third party because they are traveling or living overseas. Always heed warning signs.

Fake Ads - The number of fake ads being placed on classified sites continues to increase. If you have knowledge of an ad being fake, please report it by clicking the “Flag Ad” button. You can also send the Horse ID to our help desk along with the information you have. Before buying a horse online, always be sure to do your homework. Request references, check identities, inquire after the horse/owner on the appropriate breed association site, have your vet examine the horse and buy locally if it is possible.

Payment Scams -

  • Western Union Scam. Never use a money transfer service such as Western Union. If a request is made for the money to be sent via western union or wire transfer or for the difference to be sent to them or their shipper through these means, be aware that this may be an attempt to defraud you of your money.

  • False Payment Scam. If you are contacted by someone claiming that your payment was not completed and a request is made for your credit card information, this is a scam. Never release any personal information or credit card information to someone who contacts you claiming to be from the website’s secure payment provider.

Above all, use common sense. If an ad seems too good to be true, it probably is!

1. Introduction

Digital Pineapple Cannery Pty Ltd ("Company" or "we") wants you to be familiar with how we collect, use and disclose information from and about you. This Privacy Policy describes our practices in connection with information collected through all our services including advertising services, websites, mobile sites, the Member Centre and widgets, competitions and customer surveys (collectively, the "Company Services").  By using Company Services, you agree to the terms and conditions of this Privacy Policy. 

This Privacy Policy applies to all persons who interact with us, including those who are advertisers, subscribers to our goods or services and registered and unregistered users of Company Services.  This Privacy Policy applies to Company's collection and use of your personal information (i.e. information about an identified or reasonably identifiable individual, such as full name or name and postal address).   

2.  What information do we collect?

Company collects the personal information needed to provide Company Services and for our business operations.  If you choose not to provide certain personal information to us, we may not be able to provide you with the services you require.  The following are the main types of personal information collected by Company and the main purposes for which they are collected.

Registration Information is the information you provide to Company in the course of registering for or acquiring a Company Service, for example, to create an account, submit an enquiry, become a subscriber, become an advertiser, post comments, receive a newsletter, or enter a competition.  Registration Information may include, for example, name, delivery or postal address, email address, telephone number, gender and birthday.  It includes additional information which you provide to Company in the course of that relationship.  Where possible you may have the option of interacting with us anonymously (for example when browsing our digital products as a casual user) or using a pseudonym.  We will usually make it clear whenever this is an option.

Public Information and Posts consist of comments or content that you post to the Company Services and the information about you that accompanies those posts or content, which may include a name, user name, comments, likes, tweets, status, profile information and picture(s).  Public Information and Posts are always public, which means they are available to everyone and may be displayed in search results on external search engines.

Information from third party Social Media.  If you access or log-in to a Company Service through a third party social media service or connect a Company Service to a third party social media service, the information we collect may also include your user ID and/or user name associated with that social media service, any information or content you have permitted the third party social media service to share with us, such as your profile picture, email address, followers or friends lists, and any information you have disclosed in connection with that social media service.  We do not collect your passwords other than in relation to our own services.  When you access the Company Services through third party social media services or when you connect a Company Service to third party social media services, you are authorizing Company to collect, store use and disclose such information and content in accordance with this Privacy Policy.

Activity Information - cookies and other technologies.  When you access and interact with the Company Services, we may collect certain information about those visits.  For example, in order to permit your connection to the Company Services, our servers receive and record information about your computer, device, and browser, including potentially your IP address, browser type, and other software or hardware information. If you access the Company Services from a mobile or other device, we may collect a unique device identifier assigned to that device, geolocation data, or other transactional information from that device.

Cookies and other tracking technologies (such as browser cookies and local storage, pixel beacons, and Adobe Flash technology including cookies) are comprised of small bits of data or code that often include a de-identified or anonymous unique identifier.  Websites, apps and other services send this data to your browser when you first request a web page and then store the data on your computer so that such websites, apps and other services can access information when you make subsequent requests for pages from that service.  These technologies may also be used to collect and store information such as pages you have visited, content you have viewed, search queries you have run and advertisements you have viewed in relation to your usage of the Company Services and other websites you have visited.

Third parties that support the Company Services by serving advertisements or providing services, such as allowing you to share content or tracking aggregate Company Services usage statistics, may also use these technologies to collect similar information. Company does not control these third-party technologies and their use is governed by the privacy policies of those third parties using such technologies.

Most browsers are initially set to accept cookies, but you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether.  Please consult the "Help" section of your browser for more information.  Users can manage the use of Flash technologies, with the Flash management tools available at Adobe's website.  Please note that by blocking any or all cookies you may not have access to certain features, content or personalization available through the Company Services.

This site uses Google Analytics to collect anonymous, aggregated audience data in order to measure user interactions on our site and improve our service. This includes the use of Google Analytics Advertiser Features which provides Demographic and Interest reports, Remarketing, GDN Impression Reporting, and the DoubleClick Campaign Manager integration. Information from Other Sources.  We may supplement the information we collect with information from other sources, such as commercially available sources and data providers, as well as information from our business partners or related and affiliated companies in Australia or internationally.

Company also collects personal information about individuals who are, or are employed by, our suppliers (including service and content providers), contractors, dealers, related companies, agents and corporate customers.  Generally, if appropriate, we will state why we are collecting personal information when we collect it and how we plan to use it, or these things will be obvious when we collect the information. 

3. How do we use your information?

We use the information we collect from and about you to provide the Company Services and features to you, including: to measure and improve those Company Services and features; to improve your experience with both online and off-line Company Services by delivering content Company believes you are likely to find relevant and interesting, including advertising and marketing messages; to allow you to submit a vehicle enquiry or to submit a car for sale; to allow you to comment on content, and participate in games, competitions, or rewards programs; to provide you with customer support and to respond to inquiries.  When you are not reasonably identifiable in relation to the information collected from or about you, we may use that information for any purpose or share it with third parties. 

We may also de-identify the information we collect about you so that we can use and disclose it to third parties without using or revealing any personal information about you. This includes disclosing your email address to third parties in a hashed, non-human readable form that does not identify you and is non-reversible.

We may also use your information to improve Company Services including through research and data analysis by us and our service providers.  Where your personal information is contained in a user generated post or in a communication to an editor or journalist, we may publish your name and suburb to identify you as the author of the comment/correspondence if we choose to publish comment/correspondence in any media.  We may use and disclose your personal information in other ways expressly disclosed at the point of collection.  If you are a competition winner we may disclose your information to relevant regulatory authorities and publish your details in accordance with the competition terms.

To allow service and content providers to assist us in providing and managing the Company Services.  Company may make your information available to certain third party service and content providers, such as providers of data cloud services, website hosting service providers, debt collection services and direct marketing services, who help us manage or provide the Company Services or provide Company with related services.  These third parties may be located in a range of different countries including the United Kingdom, United States of America and Singapore.  Company generally requires these service and content providers to comply with relevant privacy laws and not to use personal information which Company provides for any purpose other than the specific service they are providing to you and/or Company.

To allow social sharing functionality.  If you log in with or connect a social media service account with Company Services, we may share your user name, picture, tweets and likes, as well as your activities and comments with other Company Services users and with your friends associated with your social media service. We may also share the same information with the social media service provider. By logging in with or connecting your Company Services account with a social media service, you are authorizing us to share information we collect from and about you with the social media service provider, other users and your friends and you understand that the social media service's use of the shared information will be governed by the social media service's privacy policy.  If you do not want your personal information shared in this way, please do not connect your social media service account with your Company Services account and do not participate in social sharing on Company Services.

To provide co-branded services and features.  We may offer co-branded services or features, such as competitions or other promotions together with a third party ("Co-Branded Services").  These Co-Branded Services may be hosted on Company Services or on the third party's service.  By virtue of these relationships, we may share the information you submit in connection with the Co-Branded Service with the third party.  The third party's use of your information will be governed by the third party's privacy policy.  We will advise you when this is occurring or obtain your express consent to share your personal information in these circumstances.

To deliver relevant advertisements.  Company and our advertisers may use the information we collect from and about you to deliver relevant ads to you when you use the Company Services or another service.  Please refer to Section 6 below for information about your choices in connection with the advertisements you see when using the Company Services.  You can view and edit your ads preferences as well as opt out of certain advertising services at http://www.google.com/ads/preferences/?hl=en.

To contact you.  Company may periodically send promotional materials or notifications which it believes might be of interest to you.  Promotional materials may include invitations to participate in various activities (such as customer surveys) or special offers. 

To share with business partners.  Where you have expressly consented to this, Company may share your information with business partners to permit them to send you marketing communications consistent with your choices. 

To protect the rights of Company and others.  There may be instances when Company may disclose your information, including situations where Company has a good faith belief that such disclosure is necessary in order to: (i) protect, enforce, or defend the legal rights, privacy, safety, or property of Company, our related companies or their employees, agents and contractors (including enforcement of our agreements and our terms of use); (ii) protect the safety, privacy, and security of users of the Company Services or members of the public; (iii) protect against fraud or for risk management purposes; (iv) comply with the law or legal process in any country; or (v) respond to requests from public and government authorities. 

To complete a merger or sale of assets.  If Company sells all or part of its business or makes a sale or transfer of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, Company may transfer or disclose your information to the party or parties involved in the transaction as part of that transaction and as part of any due diligence processes which take place in contemplation of a potential transaction.

 

4. How do we protect your information?

Company uses commercially reasonable administrative, technical, personnel and physical measures to safeguard information in its possession against loss, theft and unauthorized use, disclosure or modification. However, no one can guarantee the complete safety of your information.

5. How can you access your information?

If you would like to access, review, correct or update your personal information, you may contact us as outlined in section 7 of this policy. In your request, please include your email address, name, address, and telephone number and specify clearly what information you would like to access, review, correct or update. We will need to share your information with others who can assist in responding to your request.  We will try to respond to your request as soon as reasonably practicable.  If we deny access in any circumstances we will generally tell you why.

6. How can you opt out?

 7. Other important information for you

Updates to Privacy Policy.  Company may modify this Privacy Policy at any time.  Please look at the Last Updated date at the top of this Privacy Policy to see when this Privacy Policy was last revised.  Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Company Services.  If the changes affect any agreement between us, you will be entitled to terminate our agreement if those changes are not acceptable to you, on reasonable grounds.

Location of Data.  Some of the Company Services are hosted in and managed outside of Australia and in dealing with Company, you consent to having any personal information accessible from or transmitted outside of Australia.

Linked Services.  The Company Services may also be linked to sites operated by unaffiliated companies, and may carry advertisements or offer content, functionality, games, newsletters, competitions or applications developed and maintained by unaffiliated companies. Company is not responsible for the privacy practices of unaffiliated companies and once you leave the Company Services or click an advertisement you should check the applicable privacy policy of the other service.   

Collection of Personal Financial Information by a Payment Service. In some cases, we may use an unaffiliated payment service to allow you to purchase a product or make payments ("Payment Service").  If you wish to purchase a product or make a payment using a Payment Service, you will be directed to a Payment Service webpage.  Any information that you provide to a Payment Service will be subject to the applicable Payment Service's privacy policy, rather than this Privacy Policy.  We have no control over, and are not responsible for, any Payment Service's use of information collected through any Payment Service.

Data Retention.  We will retain your information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law.

Remember that even after you cancel your account, copies of some information from your account may remain viewable in some circumstances where, for example, you have shared information with social media or other services.  Because of the nature of caching technology, your account may not be instantly inaccessible to others.  We may also retain backup information related to your account on our servers for some time after cancelation for fraud detection or to comply with applicable law or our internal security or other policies.  We do not always completely remove or delete all of your information for a number of reasons including due to technical and systems constraints, contractual, financial or legal requirements.

Sensitive Information.  We ask that you not send us, and you not disclose, any sensitive personal information (such as information related to racial or ethnic origin, religion or other beliefs, health, criminal background or trade union membership) on or through the Company Services or otherwise. If, contrary to this request, you do provide any sensitive information, in doing so you consent to us collecting and handling that information in accordance with this Privacy Policy.

Complaint.  If you think we have breached the Privacy Act or other applicable privacy laws, you may complain to us by contacting us as outlined in section 8 below.   When you contact us, please include your email address, name, address, and telephone number and clearly describe your complaint.  We will need to share your information with others who can assist in responding to your complaint.  We will respond to your complaint as soon as reasonably practicable and in any event within 5 business days, by making contact with you to inform you whether we have accepted your complaint, need further information or do not think we are in breach. We will also let you know the next steps in resolving your complaint.  If you are not satisfied with our response to your complaint, or at any time, you may refer your complaint to the Office of the Australian Information Commissioner (www.oaic.gov.au).

Live chat Site is provided to you by technology owned and operated by third parties. Those third parties may collect, store and use information from and about you for the benefit of the Company or other third parties such as dealers. Such content may contain personal information about you such as your name and location, and may be stored by third parties operating any live chat box in various overseas locations including but not limited to the US, the EU and Australia. By accessing or using the Horseyard you agree to be bound by these terms and conditions of use (and the other terms and conditions and policies referred to in these terms and conditions and any other notices) as amended from time to time.

1. About Horseyard

(a) Horseyard publishes or makes available on the Horseyard website information, advertisements, product and service offers links and other content supplied by Horseyard and third parties (Material). Horseyard does not warrant, represent, authorise or endorse the reliability, accuracy or completeness of any such Material published on the Horseyard website or on any web site that links from the Horseyard website. (including third party display advertisements).

(b) Horseyard does not provide any warranty in relation to any goods or services advertised for sale on the Horseyard website by third parties including, but not limited to, any representation or warranty that the goods or services are of merchantable quality, fit for the purpose intended, safe for the purpose intended, as described by the seller or owned by the seller.

2. Personal and Non Commercial Use Only

(a) Use of the Horseyard website is for your personal and non-commercial use only. Except for the Material held in your computers cache or a single permanent copy of the Material for your personal use you must not without the prior written approval of Horseyard:

3. You are Responsible for the use of the Horseyard website

(a) Whilst Horseyard takes care to ensure that the Material on the Horseyard website is correct, current and free from errors, Horseyard does not warrant the accuracy or completeness of or the representations made in the Material on the Horseyard website or any web site that links from the Horseyard website or any information received as a result of using the Horseyard website. (c) You agree to indemnify Horseyard against any liability, loss, claim or demand if Horseyard (or any of its officers, representatives, employees or agents) suffers any loss or damage or incurs any cost in connection with a breach by you (or any of its officers, representatives, employees or agents) of these terms and conditions.

(d) You must keep your username and password to access the Horseyard website secure and confidential and not provide those details to any third party under any circumstance. You represent and warrant to Horseyard that you accept all liability for any unauthorised use of any username and password issued to you.

4. Goods and Services Provided By Horseyard

If Horseyard offers goods or services to you, including advertising any item for sale on the Horseyard website, the services are subject to additional terms and conditions. To the extent of any inconsistency between these terms and conditions and the additional terms and conditions, the additional terms will prevail to the extent of the inconsistency.

5. Goods and Services Provided By Third Parties

(a) If goods and services are offered on or through the Horseyard website by third parties (sellers):

  • Horseyard does not act as any persons agent or broker; arrange any contract between you and any person or; provide any warranty in relation to any persons goods or services;
  • Horseyard will not be responsible for the terms of any transaction between you and any person; any goods or services purchased by you from any person or; resolving any dispute between you and any person.

6. Horseyards Liability to You is Limited

(a) Other than as set out in this clause, and to the full extent permitted by law, all rights, remedies, conditions, guarantees and implied and express warranties in respect of any goods or services provided by Horseyard are HEREBY EXCLUDED.

(b) To the full extent permitted by the law, Horseyard will only be liable to you:
pursuant to any guarantee, right or contractual term that arises, is created or is implied by operation of law and that cannot be excluded PROVIDED THAT, to the full extent permitted by law, any such liability of Horseyard is limited, at Horseyard’s option, to (A) replacing or repairing the relevant goods, (B) supplying goods equivalent to the relevant goods, (C) supplying the relevant services again or (D) paying the cost of such replacement, repairs or supply;
subject always to subclause 6(d), if Your claim arises from or in connection with any deliberate breach of these terms and conditions or fraud by Horseyard.

(c) Subject to subclause 6(b), and except to the extent that liability cannot be excluded, Horseyard, will not be liable to you: for claims arising out of or in connection with your access and use of the Horseyard website and related services whether arising in contract, tort (including negligence), indemnity, strict liability, breach of warranty or statute;

(d) To the full extent permitted by law, Horseyard will not be liable to you for loss of use, production, profit, revenue, business, data, contractor anticipated savings or for delay or for any financing costs or increase in operating costs or any economic loss for any indirect or consequential loss or damage.

(e) For the purposes of this section, the term Horseyard will mean Horseyard, its officers, employees, contractors and agents, whether individually or collectively.

(f) These terms and conditions will survive the expiration or termination of this agreement.

7. Copyright, Trademarks and Licence

(a) Material on the Horseyard website is © Horseyard and is protected by Australian and international copyright and intellectual property laws. All rights not expressly granted under these terms and conditions are reserved by Horseyard. Unless otherwise indicated on the Horseyard website, the material on the Horseyard website is owned by or licensed to Horseyard and is subject to copyright (the "Copyright Material").

(b)You may:
only copy or reproduce the Copyright Material for the purpose of browsing the Horseyard website or making a copy for your own personal, private or research use, provided that such use constitutes fair use under the Copyright Act;
not alter or modify the Copyright Material in any way or remove any legal notice associated with it.

(c) Product and company names mentioned on the Horseyard website may be the trademarks of their respective owners. Nothing displayed on the Horseyard website should be construed as granting you any intellectual property rights including the right to use any trademark, without Horseyards (or the relevant owner’s, if applicable) express written consent.

(d) In consideration of Horseyard allowing you to access and use the Horseyard website you grant to Horseyard a non exclusive, payment free, perpetual, irrevocable licence to reproduce, modify, delete, adapt and publish any material you post, upload or otherwise transmit via Communications Services and to sub-licence the same for such purposes as Horseyard determines from time to time (subject to the Privacy Policy). You warrant that: you have all necessary rights in the content that you contribute, the content is not defamatory, that it does not infringe any law and you indemnify Horseyard, its officers, agents and contractors against any liability, loss, claim or demand arising out of or in respect of a breach of that warranty. 8. Membership to the Horseyard website

(a) If you choose to become a member of the Horseyard website, additional products and services may be made available to you.

(b) By becoming a Horseyard member, you agree to receive electronic communications from Horseyard about its products and services.

(c) If you choose to utilise membership products and services, you agree to abide by any additional terms and conditions of those specific products and / or services.

9. Communications Services

(a) Horseyard may provide you with the ability to communicate with Horseyard, the Horseyard website, Sellers, advertisers and users of the Horseyard website through agreements, online forms, , electronic requests and enquires, bulletin boards, blogs, competition entries, online forums, inbound phone number services and other forms of electronic messaging (Communications Services).

(b) You acknowledge that Communications Services may be public and not private communications. Further, you acknowledge that Communication Services may be collected, stored and scanned by Horseyard. You should not however, consider Communication Services to have been reviewed, screened, or approved by Horseyard.

(c) Use of the Communications Services is provided on condition that You do not do any of the following:

transmit any information or material which is knowingly incorrect, misleading or deceptive;

transmit any defamatory, infringing, obscene, indecent or unlawful information or material or information;

transmit spam, chain letters, contests, junk mail, surveys or other mass messaging;

use the Communications Services for any unlawful purpose;

post or upload files that contain software or other material or information in breach of any person's intellectual property or privacy rights.

upload files that contain viruses, corrupted files, worms, defects or any other similar software or programs that may damage the operation of another's computer or damage any of Horseyard website’s infrastructure;

delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.

advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters other than as approved by Horseyard.

download any file posted by another user of the Communications Services that you know, or reasonably should know, is unlawful or contrary to these terms and conditions.
